Terms of Service
These Terms of Service (“Terms”) are the agreement between you and HailDataHub (“HailDataHub,” “we,” “us,” or “our”) for use of haildatahub.com and related emails, reports, alerts, and tools (the “Service”). By using the Service, creating an account, buying a product, or clicking to accept, you agree to these Terms.
1. What HailDataHub is (and is not)
HailDataHub provides hail-related data, live logs, forecasts, outlooks, and paid reports for storm chasers, repair professionals, and other users who want organized weather information.
- Not insurance. Nothing we publish is an insurance policy, claim decision, damage appraisal, or proof of loss.
- Not a government forecast. We are not the National Weather Service, NOAA, SPC, or any government agency. We may cite or rearrange public weather products, but our packaging, maps, commentary, and paid reports are our work product.
- Not legal, financial, or professional advice. Use your own judgment and official sources for safety decisions.
2. Free content vs paid content
Some parts of the site (such as the free live hail log, when available) may be offered without charge. Paid products include subscriptions, one-issue forecasts, and report packets. Paying for a product gives you a limited license to use that product as described below — it does not transfer ownership of our copyright or trademarks.
3. License to use paid materials (no posting)
Purchase does not equal permission to publish. When you buy (or are given access to) paid HailDataHub materials, you receive a personal, limited, non-exclusive, non-transferable license only. You do not buy the copyright, and you do not buy the right to republish.
You may:
- View and download the materials for your own business or personal use; and
- Share them only with people inside your own company who need them for that same internal use (for example, your crew or office) — not with the public, customers at large, or competing shops as a handout.
You may not, without our prior written permission:
- Post, upload, publish, or republish paid materials anywhere online (website, blog, social media, Facebook/Telegram/Discord groups, forums, YouTube, Drive/Dropbox public links, or similar);
- Forward paid PDFs or report packs to people outside your company so they can avoid buying their own access;
- Resell, rent, sublicense, barter, or charge others for our materials;
- Remove HailDataHub branding, notices, or watermarks;
- Use our name or materials to imply we endorse a claim, repair estimate, or insurance outcome; or
- Scrape, bulk-download, or automate collection of the Service beyond normal use.
Violation of this section is grounds for immediate suspension or termination of your account and paid access, with no refund for the period of misuse. We may also pursue copyright and contract remedies. If you want a redistribution or white-label license, ask us in writing first. We may refuse or charge separately.
4. Accounts, subscriptions, and legacy plans
You must provide accurate account information and keep login details private. You are responsible for activity under your account.
Subscription prices, billing periods, and included features are shown at checkout or on your order. Yearly plans renew unless cancelled under the cancellation rules shown at purchase or in your customer portal (when available).
Legacy and special plans. If you are on an older, founding, lifetime, or other special plan we already sold you, that plan stays under the deal you already have. New prices and Payment Links do not change those existing plans unless you and we both agree in writing.
5. Payments and refunds
Payments are processed by Stripe or another processor we name. Taxes may apply where required. Because digital forecasts and reports are delivered promptly and can be copied, all sales are generally final once the product is delivered or access is granted, except where the law requires otherwise or we state a different refund policy at checkout.
6. Text / email alerts (if you opt in)
If you sign up for hail texts or emails, message volume can be high on busy storm days (hundreds of messages is possible). Message and data rates may apply. Reply STOP to opt out of SMS where that option is offered. Alerts are not a replacement for official Wireless Emergency Alerts or local emergency instructions.
7. Accuracy and availability
Weather data changes fast. Sources can lag, fail, or be incomplete. The Service may be delayed, incomplete, or temporarily offline. We do not promise that any report, map, size, time, or location is perfect or complete.
8. Your conduct
You agree not to misuse the Service, break the law, harass others, attempt unauthorized access, or interfere with the site. Unauthorized posting or sharing of paid materials is a material breach. We may suspend or close access immediately, without refund, if these Terms are violated.
9. Intellectual property
HailDataHub name, logos, site design, software, and original report content are owned by us or our licensors. Public weather agency text or data remains subject to those agencies’ rules; our selection, arrangement, maps, commentary, and packaging remain ours.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FIT FOR INSURANCE, LEGAL, OR SAFETY-CRITICAL USE.
11. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, HAILDATAHUB AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR INSURANCE OUTCOMES, ARISING FROM THE SERVICE OR THESE TERMS — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE PRODUCT OR SUBSCRIPTION PERIOD GIVING RISE TO THE CLAIM (OR $100 IF YOU PAID NOTHING).
12. Indemnity
You agree to defend and hold us harmless from claims, damages, and costs (including reasonable attorneys’ fees) arising from your misuse of the Service, your violation of these Terms, or your unauthorized publishing or sharing of paid materials.
13. Changes
We may update these Terms by posting a new version on this page with a new “Last updated” date. Continued use after changes means you accept the updated Terms. Material changes to a paid plan you already bought will not rewrite that past purchase except as allowed by law or your original plan terms.
14. Governing law
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law rules, unless mandatory consumer law in your place of residence says otherwise. Courts in Sangamon County, Illinois (or the federal court covering that area) are the venue for disputes that must go to court, subject to those mandatory consumer protections.

If any part of these Terms is found unenforceable, the rest still applies. Our failure to enforce a right is not a waiver of that right.
